Terms of Service

Overview

These Terms of Service govern access to and use of all ArchiVerif products, including the ArchiVerif mobile application (iOS and Android), the website at archiverif.ca, and the ArchiVerif REST API. By downloading the app, accessing the website, or using the API, you agree to be bound by these terms. If you do not agree, do not use the service. ArchiVerif is operated by Mohaned Bouzaidi, a sole proprietor based in Brossard, Quebec, Canada.

1. Definitions

In these Terms of Service, the following definitions apply:

  • "ArchiVerif" refers to the platform operated by Mohaned Bouzaidi, including the mobile app, the website at archiverif.ca, and the REST API.
  • "App" refers to the ArchiVerif mobile application available on iOS (Apple App Store) and Android (Google Play).
  • "Watchlist" refers to the list of contractors a Client monitors for licence status changes via the App.
  • "API" refers to the ArchiVerif REST API endpoints, including /v1/verify/{licence_id} and /v1/suspensions/today.
  • "Client" refers to any individual, business, or organization that registers for and uses the ArchiVerif API.
  • "API Key" refers to the unique authentication credential issued to each Client via RapidAPI.
  • "RBQ Data" refers to contractor licence data sourced from the Régie du bâtiment du Québec open dataset, published under CC BY 4.0.
  • "Subscription" refers to the paid or free tier plan selected by the Client, either via Stripe (App/Website) or RapidAPI (enterprise API).

2. Acceptance of terms

By downloading the ArchiVerif app, registering an account, accessing the website, or integrating any ArchiVerif API endpoint, you confirm that you have read, understood, and agree to these Terms of Service and the ArchiVerif Privacy Policy, available at archiverif.ca/privacy. If you are accepting these terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these terms.

3. API access and permitted use

3.1 Licence grant

Subject to your compliance with these Terms of Service and payment of applicable fees, ArchiVerif grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the ArchiVerif API solely for your internal business operations.

3.2 Permitted uses

You may use the ArchiVerif API to:

  • Verify the current RBQ licence status of contractors as part of your internal compliance, underwriting, onboarding, or risk management workflows.
  • Receive and process suspension alerts for contractors within your portfolio or platform.
  • Integrate API responses into your own software products, provided that ArchiVerif data is not resold or redistributed as a standalone data product.
  • Display licence verification results to your end users as part of your own product interface, with proper source attribution.

3.3 Prohibited uses

You may NOT use the ArchiVerif API to:

  • Resell, sublicense, or redistribute raw RBQ Data as a standalone data feed or API product to third parties.
  • Build a competing contractor licence verification API service using ArchiVerif as a data source.
  • Scrape, bulk-download, or systematically extract the entire ArchiVerif dataset beyond your subscribed query limits.
  • Circumvent rate limits, abuse the API infrastructure, or attempt to access endpoints without a valid API key.
  • Use the API for any purpose that violates applicable Quebec or Canadian law, including Quebec Law 25 and PIPEDA.
  • Display or use the RBQ logo, Quebec government flag, or any government insignia in connection with data retrieved from ArchiVerif.

4. API keys and authentication

API keys are issued and managed by RapidAPI on behalf of ArchiVerif. Each API key is personal to the registered Client and must not be shared, published, or transferred to any third party.

You are responsible for:

  • Keeping your API key confidential and secure at all times.
  • All API calls made using your API key, whether authorized by you or not.
  • Notifying ArchiVerif immediately at MohanedB@archiverif.ca if you suspect your API key has been compromised.

ArchiVerif reserves the right to revoke any API key at any time if misuse, abuse, or a breach of these Terms is detected.

5. Subscription plans and billing

5.1 Subscription tiers

ArchiVerif offers multiple subscription tiers through RapidAPI, including a free Developer tier and paid Growth, Business, Enterprise, and Enterprise Unlimited tiers. Each tier includes a monthly query allowance as specified on the RapidAPI listing page.

5.2 Overage charges

Queries exceeding your monthly allowance are billed at the overage rate applicable to your subscription tier. Overage rates are displayed on the RapidAPI listing and may be updated with 30 days' notice.

5.3 Billing and payment

App subscriptions are billed through Stripe. Enterprise API subscriptions are billed through RapidAPI. ArchiVerif never stores or processes payment card information directly. Subscription fees are charged monthly in advance. Failure to maintain payment may result in suspension of access.

5.4 Refunds

Subscription fees are non-refundable except where required by applicable law. If you believe a billing error has occurred, contact ArchiVerif at MohanedB@archiverif.ca within 30 days of the charge.

6. Data accuracy and disclaimer

ArchiVerif sources all contractor licence data from the official RBQ open dataset published daily by the Régie du bâtiment du Québec under CC BY 4.0. ArchiVerif updates its database daily following each RBQ publication.

However, ArchiVerif makes no warranty, express or implied, regarding the accuracy, completeness, timeliness, or fitness for a particular purpose of the data provided. Specifically:

  • Data reflects the RBQ dataset as of the most recent daily update and may not reflect intraday licence changes.
  • ArchiVerif is not responsible for errors or omissions in the source RBQ dataset.
  • Licence verification results must not be used as the sole basis for high-stakes legal or financial decisions without independent confirmation.

The authoritative source for RBQ licence status is always the Régie du bâtiment du Québec official registry at rbq.gouv.qc.ca.

7. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VERIFRBQ AND ITS OPERATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE API, INCLUDING BUT NOT LIMITED TO LOSS OF REVENUE, LOSS OF DATA, OR BUSINESS INTERRUPTION.

ArchiVerif's total cumulative liability to you for any claims arising under or related to these Terms shall not exceed the total fees paid by you to ArchiVerif in the three months preceding the claim.

8. Service availability and SLA

ArchiVerif targets high availability for the API but does not guarantee uninterrupted service. Planned maintenance, infrastructure issues, or upstream failures at Railway or RapidAPI may cause temporary unavailability.

Enterprise Unlimited clients may negotiate a formal Service Level Agreement (SLA) with defined uptime guarantees. All other subscription tiers are provided on a best-effort basis with no uptime guarantee.

The ETL pipeline runs daily at 4:00 AM UTC. Data freshness is guaranteed to within 24 hours of the most recent RBQ publication under normal operating conditions.

9. Source attribution obligation

In compliance with the CC BY 4.0 licence under which RBQ data is published, every use or display of ArchiVerif data in your product or communications must include the following attribution:

"Source: Régie du bâtiment du Québec (CC BY 4.0)"

You must not imply any affiliation with, endorsement by, or official status from the Régie du bâtiment du Québec or the Government of Quebec.

10. Termination

You may terminate your ArchiVerif subscription at any time by cancelling through your RapidAPI account. Access will continue until the end of the current billing period.

ArchiVerif reserves the right to suspend or terminate your API access immediately and without notice if you breach any provision of these Terms of Service, misuse the API, or fail to pay applicable fees.

Upon termination, all licences granted under these Terms immediately cease. Provisions relating to data accuracy disclaimers, limitation of liability, and governing law survive termination.

11. Modifications to these Terms

ArchiVerif reserves the right to modify these Terms of Service at any time. Updated terms will be posted at archiverif.ca/terms with a revised effective date. For material changes, ArchiVerif will notify active Clients by email at least 15 days before the changes take effect. Continued use of the API after the effective date constitutes acceptance of the revised terms.

12. Governing law and dispute resolution

These Terms of Service are governed by and construed in accordance with the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any dispute arising from or relating to these Terms shall first be submitted to good-faith negotiation between the parties. If unresolved within 30 days, disputes shall be submitted to the exclusive jurisdiction of the courts of the Province of Quebec.
